You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

6. Service Availability and Modifications

Volcano Software Inc. does not warrant that:

• The services will meet your specific requirements
• The services will be uninterrupted, timely, secure, or error-free
• Any defects in the service will be corrected
• The results obtained from the use of the service will be accurate or reliable

We reserve the right to modify or discontinue services with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the services.

7. Limitation of Liability

In no event shall Volcano Software Inc., its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the services, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability in connection with your use of the services shall not exceed $100 USD.

You agree to indemnify, defend, and hold harmless Volcano Software Inc., its affiliates, officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or relating to: (a) your use of the services; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) any user content you post or transmit through the services.

9. Dispute Resolution and Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States and the State where Volcano Software Inc. is incorporated. Any disputes arising under or in connection with these terms shall be resolved through binding arbitration administered by a neutral arbitration body, rather than in court. Volcano Software Inc. may terminate or suspend your account and access to the services immediately, without prior notice or liability, for any reason, including if you breach any term of these Terms of Service. Upon termination, you must cease use of the services and destroy all materials obtained from the services in your possession.

If any provision of these terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it will be severed, and the remaining provisions will continue in full force and effect.
